Mr. Gudobba called the meeting to order at 6:30 p.m.

APPROVAL OF AGENDA

Motion by Mr. Landa, supported by Mr. Consiglio, to approve the agenda as submitted. Motion carried.

Mr. Gudobba explained the procedure for a Public Hearing to be as follows: the petitioner will make comments, the public will have an opportunity to ask questions and the Planning Commission will have opportunity to make comments or ask questions.

 

 

25.328 ACRES OF LAND LOCATED AT THE SOUTHWEST CORNER OF CASS AVENUE AND CLINTON RIVER ROAD (SECTION 9)

Pertinent correspondence was read and entered into the record. Ms. Trombley noted that110 notices were mailed to owners and occupants within 300 feet of the subject property and 14 were returned as undeliverable. Ms. Trombley read a letter into the record from Fred Neuman, 19780 Woodview, Normandy Forest, Clinton Township, Michigan 48038, suggesting that the Township purchase land for an access road for Normandy Forest for safety reasons.

Mr. Wolff, 20061 Shoals, Clinton Township, Michigan 48038, inquired as to whether there is a buyer for the property.

Mr. Cassin stated that the Township is not involved with the sale of the property. He stated that the rezoning is consistent with the Master Plan Mr. Wolff inquired as to why the Township is changing the zoning if the property is not being sold.

Mr. Cassin stated that the current zoning is not appropriate for the area. He added that the property owners could object to the rezoning.

Mr. Wolff stated his opinion that a B-1 zoning would create more traffic problems.

Mr. Cassin stated that a B-3 zoning has a higher density.

Fred Neuman, 19780 Woodview, Normandy Forest, Clinton Township, Michigan 48038, stated that Normandy Forest development only has one access to Canal through Northwinds Subdivision and a temporary road into West River Estates. He suggested that the Township purchase Parcel "B" and develop an access for Normandy Forest in order to provide access to a major road.

Mr. Gudobba reminded that the purpose of this public hearing is to consider the rezoning only.

Mr. Neuman stated that since 18 Mile Road is not scheduled to be developed he has concerns that safety vehicles cannot access his subdivision.

Tim Stoepker, Dickinson Wright, 500 Woodward, Ste 400, Detroit, Michigan, representative for Rose Garden property owner, stated objections to the rezoning. He added that with the expansion of 18 Mile Road in question, the property is suitable for residential because of the 120 foot right-of-way that would be required. He stated that the rezoning is premature until the issue of 18 Mile Road expansion is resolved. He stated that the Master Plan does not show the right of way for 18 Mile Road.

Mr. Gudobba inquired as to whether Mr. Stoepker痴 opinion is that Parcel "B" could be developed as residential.

Mr. Stoepker stated that Parcel "B" could not be developed as residential until the expansion of 18 Mile Road is solved.

Motion by Mr. Nickerson, supported by Morrissette, with reference to File #4832 and application from the Charter Township of Clinton, 40700 Romeo Plank, Clinton Township, Michigan 48038, concerning rezoning for 25.328 acres of land located at the southwest corner of Cass Avenue and Clinton River Road (Section 9) from B-3 General Business to B-1 Neighborhood Business (Parcel A ) and R-4 One-Family Residential (Parcel B), to close the public hearing, and recommend to the Township Board the approval of the rezoning from B-3 General Business to R-4 Single and B-1 Neighborhood Business for the following reasons: 1) the request is consistent with the Master Plan; 2) the parcel can be easily developed as residential and 3) a residential development would be compatible with the already established development patterns in the area.. Roll Call Vote: Aye- Nickerson, Morrissette, Consiglio, Gudobba, Landa, O誰eal, Roach, Tomlinson, Trombley. Nay- None. Absent- None.

Pertinent correspondence was read and entered into the record.

Michael McClain, Webber Development, 33414 Kelly Road, Clinton Township, Michigan 48035, stated it is important that he have the access road to M-59. He stated he will only use the existing curb cuts. He added that the middle building will be used as a museum for local school field trips.

Mr. Gudobba stated that the Planning Department is recommending only one access from Morley Drive. He inquired as to whether the petitioner is agreeable to closing the curb cuts to M-59.

Mr. McClain stated that is based on whether the Michigan Department of Transportation will issue the permit. He stated that if a permit is not issued he will not have the approach.

Mr. Morrissette stated that he owned property in the area and the access road was only used for trucks.

Mr. Gudobba stated that the property could be sold and the use could change.

Mr. Cassin stated the Planning Commission could recommend approval subject to the petitioner submitting a letter of approval from the Michigan Department of Transportation before submitting to the Township Board.

Mr. Roach inquired as to whether the site could accommodate busses if the site plan is approved without the access road.

Mr. McClain stated the busses would have to back out.

Ms. Trombley inquired as to whether a museum is allowed in the current zoning district.

Mr. Cassin stated this is the first time he has heard that the petitioner is planning to put in a museum for this property.

Mr. McClain stated that the property will be used for the main office, with the middle building being used as a trophy room for the community to see.

Mr. Gudobba felt that busses in the area would create traffic problems. Mr. Gudobba felt there are three choices in handling this matter: 1) the petitioner could agree to only one access to M-59; 2) the matter could be tabled to allow the petitioner to receive approval from he Michigan Department of Transportation, or 3) the Planning Commission could vote on approval or denial.

Mr. McClain inquired as to when the Planning Commission meets again.

Mr. Gudobba stated the next Planning Commission is May 10, 2001.

Motion by Mr. Gudobba, supported by Mr. Consiglio, with reference to File #5510 and application from Michael McClain, Webber Development, 33414 Kelly Road, Clinton Township, Michigan 48035, concerning request for approval of Site Development Plan for Webber Development Company Headquarters located on Lot 1, Liberty Industrial Subdivision (Section 1), generally located at the southwest corner of Hall Road and Morley Drive, that the matter be tabled until May 10, 2001. Roll Call Vote: Aye- Gudobba, Consiglio, Landa, Morrissette, Nickerson, O誰eal, Roach, Tomlinson, Trombley. Nay- None. Absent- None. Motion carried.

Pertinent correspondence was read and entered into the record.

William Mazurkiewicz, M.A.Z. Building, Inc., 44073 Groesbeck, Suite 2, Clinton Township, Michigan 48038, stated he was not aware that a wall was required.

Mr. Cassin stated that the Township prefers not to have a wall and suggested that the petitioner meet with the adjoining residential neighbor and the school and try to get a letter signed by them stating they are agreeable to having a berm instead of the wall.

Mr. Mazurkiewicz inquired as to the length of the wall that is required.

Mr. Cassin stated approximately 227 feet along the west property line.

Motion by Mr. Tomlinson, supported by Ms. O誰eal, with reference to File #5520 and application from William Mazurkiewwicz, M.A.Z. Building, Inc., 44073 Groesbeck, Suite 2, Clinton Township, Michigan 48038, concerning request for approval of Site Development Plan for Weybridge Commons Duplexes located on 1.037 acres of land located a the northwest corner of Brynford Drive and Weybridge Drive (Section 21), that recommendation for approval of the Site Development Plan be submitted to the Township Board subject to the required wall be shown on the plan prior to submitting the proposal to the Township Board or the petitioner submitting a letter from the adjoining property owners stating they are agreeable to a berm instead of the wall. Roll Call Vote: Aye- Tomlinson, O"Neal, Consiglio, Gudobba, Landa, Morrissette, Nickerson, Trombley. Nay- None. Absent- None. Motion carried.

DISCUSSION REGARDING NEXT MEETING

Mr. Cassin stated there is a rezoning and possible site plan.
