Mr. Marella called the meeting to order at 6:30 p.m. Mr. Marella explained that the petitioner will be given an opportunity to add or clarify information and the public will be given an opportunity to speak in an orderly manner. He explained that the petitioner must state his or her hardship, which cannot be for monetary reasons and cannot be self-created.

APPROVAL OF AGENDA

Mr. Marella stated that the petitioner for Item #6 on the agenda verbally requested to have the matter withdrawn. In addition, Item #4 will be moved to Item #1.

Motion by Mr. Campbell, supported by Ms. Schwartz, to approve the agenda as amended. Motion carried.

1.5 ACRES FRONTING THE EAST LINE OF HAYES ROAD, SOUTH OF CLINTON RIVER ROAD (SECTION 19)

Pertinent correspondence was read and entered into the record. Mr. Campbell indicated that there were three (3) written replies received in response to the mailing of the Notice of Public Hearing to owners and occupants within 300 feet of the land in question: 1) letter received from Resident, 38223 Canary Court, Clinton Township, Michigan stating no objections to the variance; 2) letter received from R. Lee Gans, Clinton Township, Michigan stating the petitioner was to make changes within sixty (60) days and has not done so and she is opposed to the variance and 3) letter from Debora Gans, Clinton Township, Michigan, stating she has visited other Veterinary Hospitals in Clinton Township and all comply with the current ordinance. She is opposed to the variance.

Paul Piatt, Attorney at Law, 14 1st Street, Mt. Clemens, Michigan 48043, representative,

distributed a handout with letters from the Humane Society of the United States, Association of Veterinarians for animal rights and American Veterinary Hospital Association, stating that property contained and maintained areas are better for the animals. He stated that there have been changes in Veterinary medicine and society since the ordinance was approved in 1983. He stated that the animals are let outside at 8:00 a.m. for thirty (30) minutes and again between 5 p.m. and 7:00 p.m. for thirty (30) minutes, but the animals are on leashes and attended. He stated that the majority of other Veterinary Hospitals in the Township are leased and not owned buildings. The fence has been on the property for nine (9) years. In addition, the other Veterinary Hospitals are in Industrial- zoned areas, whereas the subject Veterinary Hospital is in a residential area. He stated that the Health Department investigated the sewage and disposal on site and stated that there is no evidence of malfunction.

Mr. Marella stated for the record that the representative summarized the documents placed on the record.

Debora Gans, 38223 Canary Court, Clinton Township, Michigan stated her property is near the subject property. She stated that at the time of the court hearing, there were sewer problems and the petitioner does not want to add the drain. She added that the petitioner did not receive permits for the fence. She stated that there is a problem with noise from the Veterinary Hospital.

Jody Monday, 38219 Canary Court, Clinton Township, Michigan, stated her backyard abuts the Veterinary Hospital. She passed out pictures of the area surrounding the Veterinary Hospital. She is opposed to the variance request.

Dr. Stephen Hoy, 38454 Hayes, Clinton Township, Michigan, stated he removed the outside kennels two (2) years ago. He stated that Ms. Stone has no objections. In addition, he indicated that the Building Department has not received complaints regarding the Veterinary Hospital.

Debora Gans, stated that the guideline at Chateau Park was to make a complaint with management at the Park. They have had some administrative problems which have been corrected and the management from Chateau Park is filing a complaint with the Township.

Mr. Campbell stated that the ordinance does not allow outside kennels. He stated that with winter weather conditions, it is hard to maintain the outside run. He stated his opinion that this request is not within the guidelines of the ordinance.

Ms. Granata stated her opinion that the Veterinary Hospital should be in an Industrial area.

Motion by Mr. Campbell, supported by Ms. Granata, with reference to File #5229 and application from Dr. Stephen B. Hoy, Lakewood Veterinary Hospital, 38454 Hayes Road, Clinton Township, Michigan 48038, as represented by Paul Piatt, Attorney at Law, 14 1st Street, Mt. Clemens, Michigan 48043, for variance to Clinton Township Planning and Zoning Code, Chapter 1298.02 -(k)-(2), OS Office/Service District: PRINCIPAL USES PERMITTED AND Chapter 1276.02-(a), B-2 Community Business District: PRINCIPAL USES PERMITTED, concerning Lakewood Veterinary Hospital located on 1.5 acres of land fronting the east line of Hayes Road, south of Clinton River Road (Section 19), that request for variance to permit continued operation of a veterinary hospital/clinic (Lakewood Veterinary Hospital) in the B-2 Community Business District with outdoor activities which are not allowed; be denied based on lack of practical difficulty shown. Mr. Miller stated that the petitioner verbally requested to table this matter, but he added that the petitioner has no plans to pursue this matter.

Motion by Mr. Campbell, supported by Ms. Schwartz, with reference to File #5204 and application from John and Tina Brodak, 16175 17 Mile Road, Clinton Township, Michigan 48038, for variance to Clinton Township Planning and Zoning Code, Chapter 1292.01-1, Land Use Regulations; SCHEDULE OF REGULATIONS LIMITING HEIGHT, BULK, DENSITY AND AREA: CHART; Minimum Side Yard Setback Requirements in the R-3 One-Family Residential District, concerning 1.42 acres fronting the north line of 17 Mile Road, west of Garfield Road (Section 18), that request for the variance to permit division of a parcel of land, developed with a single-family residence in the R-3 One-Family Residential District, creating an east side yard setback for the existing residence of four (4) feet being four (4) feet less than the required eight (8) feet, be denied based on no practical difficulty. LOT 139, VINEYARD SUBDIVISION (SECTIONS 35/36)

Pertinent correspondence was read and entered into the record. Mr. Campbell indicated that there were no written replies received in response to the mailing of the Notice of Public Hearing to owners and occupants within 300 feet of the land in question.

Jerry Seay, 16931 19 Mile Road, Clinton Township, Michigan, Attorney, representative, stated the corner lot was platted prior to the current ordinance regulations. He stated that the suggestion for combining the lots and redrawing the lot lines is not feasible as the issue would violate the Michigan Land Division Act and the petitioner has already dug two of the basements on the other lots. He added that Lot 139 is a lot on it’s own.

Mr. Campbell stated when the suggestion was made to combine the lots and redraw the lines, no work on the lots had been done. He felt that this is a self created hardship.

Ms. Schwartz inquired as to when the petitioner purchased Lot 139.

Paul Mulier, Mulier Construction, Inc., 22020 Edgewood, St. Clair Shores, Michigan 48080, stated he purchased all the lots together in approximately May of 1998.

Ms. Schwartz inquired as to the minimum square footage required under the ordinance.

Mr. Miller stated that the minimum square footage requirement is 950 square feet with a basement. He added the ordinance was adopted in 1979 and there were previously adopted versions of the ordinance.

Mr. Woodring inquired as to why the petitioner did not follow the suggestion made by the Zoning Board of Appeals.

Mr. Mulier stated that he had already applied for Building Permits at the time the suggestion was made and received them shortly after. He added he has time and money invested in the project.

Mr. Young stated it is not required to build the same house on all lots. He suggested that a smaller house on Lot 139 is possible.

Mr. Campbell feared that granting a variance would create a traffic hazard.

Ms. Granata stated there have been similar variances granted previously for other sites.

Motion by Mr. Woodring, supported by Ms. Granata, with reference to File #5220 and application from Paul & Cheryl Mulier, Mulier Construction, Inc., 22020 Edgewood, St. Clair Shores, Michigan 48080, for variance to Clinton Township Planning and Zoning Code, Chapter 1292.01, Land Use Regulations; SCHEDULE OF REGULATIONS LIMITING HEIGHT, BULK, DENSITY AND AREA: CHART; Minimum Front Yard Setback Requirements in the R-5 One-Family Residential District and Chapter 1292.01, Land Use Regulations; SCHEDULE OF REGULATIONS LIMITING HEIGHT, BULK, DENSITY AND AREA: FOOTNOTES TO CHART; Minimum Side Yard Setback Requirements in the R-5 One-Family Residential District, concerning Lot 139, Vineyard Subdivision (Section 35/36), generally located at the southwest corner of Cottrel and Pennsylvania, that variance be granted to permit construction of a single-family residence on a corner lot in the R-5 One-Family Residential District, with side yard setback from Pennsylvania Avenue of nine (9) feet being sixteen (16) feet less than the required twenty-five (25) feet; further, this grant of variance is based on practical difficulty that to deny the variance would make the lot unbuildable and create a hardship; further, this grant of variance is contingent upon compliance with all other requirements of the Township ordinances. Pertinent correspondence was read and entered into the record. Mr. Campbell indicated that there were no written replies received in response to the mailing of the Notice of Public Hearing to owners and occupants within 300 feet of the land in question.

William S. Quinlan, Quinlan & Associates, Inc., 31325 Harper, St. Clair Shores, Michigan 48082, representative, stated that the property was a Recycling Center and they are proposing to develop the property with industrial buildings. In addition, he stated that Reynolds Drive has been extended since the petition was submitted. He stated the petition is consistent with the Master Plan.

Mr. Young inquired as to whether Building "D" could be eighty (80) feet long instead of ninety (90), which would meet the ordinance.

Mr. Quinlan stated the petitioner needs the building to be 15,000 square feet. With the variance, the building could be 14,400 square feet with parking and meet the ordinance. He added that abutting land to the north is vacant and the required ten (10) foot setback does not serve a purpose.

Mr. Marella stated that if the property to the north is developed in the future, it will create a hardship on the property owner because he will need to provide a twenty (20) foot setback for his building.

Mr. Quinlan stated the owner of the property to the north is aware of the variance request and has no problems with it.

Ms. Granata inquired as to whether the petitioner has a tenant for the proposed building.

Mr. Quinlan stated there is a possible tenant.

Mr. Campbell stated that no other buildings in the area are closer than twenty (20) feet. He added they are requesting a variance for three sides.

Mr. Nickerson stated that the buildings can be moved around to get the extra 1,600 square feet needed without a variance.

LOT 2, TARA SUBDIVISION (SECTION 20)

Pertinent correspondence was read and entered into the record. Mr. Campbell indicated that there were no written replies received in response to the mailing of the Notice of Public Hearing to owners and occupants within 300 feet of the land in question.

Robert Stermer, 12672 East Outer Drive, Detroit, Michigan 48224, stated the lot has an irregular shape. He stated that two (2) other variances have been granted in the subdivision. He added that this is the last lot in the subdivision.

Mr. Campbell stated that based on his findings, only one (1) other variance in the subdivision was granted and the house abutted an open field. The subject property abuts residential. He added that the other houses in the subdivision are two (2) stories and the petitioner is proposing a one (1) story house.

Ms. Schwartz stated that the petitioner will have his elderly parents-in-law living with him and stairs would be a hardship. She added that the variance is minimal.

Mr. Young stated that any additions to the rear yard would require additional variances.

Mr. Stermer stated that the surrounding neighbors are not opposed to the variance.

Mr. Miller stated that the Zoning Board of Appeals has authority to apply reasonable conditions to the variance.

Motion by Ms. Schwartz, supported by Mr. Woodring, with reference to File #5207 and application from Robert Stermer, 12672 East Outer Drive, Detroit, Michigan 48224, for variance to Clinton Township Planning and Zoning Code, Chapter 1292. 01, Schedule of Regulations of the Planning and Zoning Code, concerning Lot 2, Tara Subdivision (Section 20), 18500 Tara, generally located fronting the north line of Tara, west of Moravian Drive, that variance be granted to permit construction of a single-family home in the R-1 District with a rear yard setback of 34.33 feet which is 5.67 feet less than required; further, this grant of variance is based on practical difficulty of an elderly couple living in the home in which stairs would make it difficult and with further practical difficulty being the irregular configuration of the lot; further, no additional request for variances into the rear yard will be considered; further, this grant of variance is contingent upon compliance with all other requirements of the Township ordinances. Roll Call Vote: Aye- Schwartz, Woodring, Granata, Nickerson, Young, Marella. Nay- Campbell. Absent- None. Motion carried.

Pertinent correspondence was read and entered into the record. Mr. Campbell indicated that there were no written replies received in response to the mailing of the Notice of Public Hearing to owners and occupants within 300 feet of the land in question.

Ronald A. Chiesa, R.A. Chiesa Architects, 39200 Garfield, Suite D, Clinton Township, Michigan 48038, stated that since the site plan was approved, they found that the building on the property to the west is ten (10) feet on the subject property. They are requesting the variance to maintain a ten (10) foot setback. He added the project is consistent with the Master Plan. In addition, the variance would only affect thirty-five (35) feet of the six-hundred and fifty (650) feet of property.

Mr. Campbell stated the site plan would need to be revised to show the actual buildings.

Mr. Woodring inquired as to whether any other variances would be needed.

Mr. Miller stated that the site plan was approved with twenty (20) feet between buildings. With the encroachment from the north, the setback would be ten (10) feet which meets the ordinance, however, there would not be twenty (20) feet between buildings.

Mr. Campbell inquired as to whether the building could be relocated and move the parking to the north and then no variance would be needed.

Mr. Chiesa stated the tenant needs the layout of the building the way it was submitted.

He stated that moving the building would change the locations of windows and doors. He replied that the tenant sells machines run by computers.

Mr. Young inquired as to whether the building could be moved back ten (10) feet.

Mr. Chiesa stated that moving the building back ten (10) feet creates a hardship for the adjacent back property.

Ms. Granata stated that the north property owner encroaching on ten (10) feet of the petitioners property has created a hardship. In addition, he has a tenant that needs the current layout.

Mr. Miller stated that the Planning Department needs to be aware whether there will be a grant of an easement or change of the legal description of the land to accomodate for the encroachment.

Mr. Marella stated that the variance would only affect thirty-five (35) feet of the property.

Chiesa Architects, 39200 Garfield, Suite D, Clinton Township, Michigan 48038, for variance to Clinton Township Planning and Zoning Code, Chapter 1292.01-(r), Land Use Regulations; SCHEDULE OF REGULATIONS LIMITING HEIGHT, BULK, DENSITY AND AREA: CHART AND FOOTNOTES: Minimum Side Yard Setback Requirements in the I-2 General Industrial District, concerning 4.552 acres fronting the west line of Groesbeck Highway, south of Metropolitan Parkway (Section 28), that variance be granted to permit construction of an industrial building (H & S Metro Investments) in the I-2 General Industrial District with north side yard setback of ten (10) feet from an existing building being ten (10) feet less than the minimum required twenty (20) feet; further this grant of variance is based on the practical difficulty that the property owner to the north is encroaching ten (10) feet onto the subject property which must be verified by a Registered Land Surveyor; further, this grant of variance is contingent upon compliance with all other requirements of the Township ordinances. 23.7 (+/-) ACRES FRONTING THE NORTH LINE OF 18 MILE ROAD, EAST OF HAYES ROAD (SECTION 7)

Pertinent correspondence was read and entered into the record. Mr. Campbell indicated that there were no written replies received in response to the mailing of the Notice of Public Hearing to owners and occupants within 300 feet of the land in question.

Sebastian Lombardo, Lombardo & Palazzolo of Clinton Township, Inc., 47200 Van Dyke Avenue, Utica, Michigan 48317, stated he is requesting a variance to improve the appearance of the buildings and to create a larger setback from the street for safety reasons.

Mr. Marella inquired as to whether the size of the units will be changed.

Mr. Lombardo stated the size of the units will not change.

Michael Gavonic, 15530 Uthers, Clinton Township, Michigan 48038, stated his condominium abuts the subject property and he would like to know why the berm was not used as a buffer.

Mr. Miller stated that the item on the agenda affects the center of the condominium complex and not the north border of the complex. He stated that the engineers allowed a sanitary sewer to be placed on the berm line, therefore, a berm cannot be placed on that line.

Paul Mazur, 15470 Uthers, Clinton Township, Michigan 48038, stated he is opposed to the variance.

George Grzywacz, 15490 Uthers, Clinton Township, Michigan 48038, inquired as to whether the variance would allow the petitioner room to build more units.

He stated concerns that the property values would decrease.

Mr. Lombardo stated he is not building any additional units with the variance. He added that the new configuration would not affect the property values.

Mr. Campbell inquired as the number of different models in the complex.

Mr. Lombardo stated there are six different models.

Mr. Campbell inquired as to whether a three unit condominium could be used as opposed to single units, then the variance would not be needed.

Mr. Lombardo stated the placement of the windows in the three units do not coincide with the location. He stated there are seven other single units in the complex. In addition, he stated he has signed purchase agreements for the proposed units.

Motion by Ms. Granata, supported by Mr. Young, with reference to File #5242 and application from Sebastian Lombardo, Lombardo & Palazzolo of Clinton Township, Inc., 47200 Van Dyke Avenue, Utica, Michigan 48317, for variance to Clinton Township Planning and Zoning Code, Chapter 1292.01-(h), Land Use Regulations; SCHEDULE OF REGULATIONS LIMITING HEIGHT, BULK, DENSITY AND AREA: CHART AND FOOTNOTES: Minimum Side/Rear Yard Setback Requirements in the RML Multiple-Family Residential (Low-Rise) District, concerning 23.7 (+-) acres fronting the north line of 18 Mile Road, east of Hayes Road (Section 7), that variance be granted to permit a revision to an approved site plan and construction of six dwelling units in four buildings (Units 20-A,B, C and 22-A, B, C, Cambridge Square Condominiums) in the RML Multiple-Family Residential District with distance between two buildings of twenty (20) feet being ten (10) feet less than the required distance of thirty (30) feet; further, this grant of variance is based on the practical difficulty of the Health, Safety and Welfare of the public because of the street and sidewalk configuration; further, this grant of variance is contingent upon compliance with all other requirements of the Township ordinances. Roll Call Vote: Aye- Granata, Young, Campbell, Nickerson, Schwartz, Woodring, Marella. Nay- None. Absent- None. Motion carried.

REPORTS OF MEETINGS

Mr. Campbell stated that in the Report of Meeting for June 17, 1998, the heading should be moved on Page 3, and on Pages 6 & 7, the practical difficulties for the two motions should be traded.

Mr. Young stated that in the Report of Meeting for June 17, 1998 , Paragraph two on Page 6 should read: "Mr. Marella stated that the Board of Appeals will make a decision based on the best interest of the Township residents/public."

Motion by Mr. Campbell, supported by Mr. Nickerson, to approve the Report of Meeting for Wednesday, June 17, 1998, with the changes noted on Pages 3, 6 & 7. Roll Call Vote: Aye- Campbell, Nickerson, Schwartz, Young, Marella. Nay- None. Absent- None. Abstained- Granata, Woodring. Motion carried.

Mr. Young stated that in the Report of Meeting for July 15, 1998, on Page 1, Paragraph two should read "Zoning Board of Appeals".

Mr. Campbell stated that in the Report of Meeting for July 15, 1998, Page 5, Paragraph 2 should read "Mr. Campbell stated his opinion that granting this variance would create a hardship for the adjoining property owners. He suggested it would be better to combine the lots and redraw the lot lines and request a variance for the side or rear yard setbacks."

Mr. Young stated that in the Report of Meeting for August 19, 1998, Pages 3 & 4, the reference to" last meeting" should state "the June meeting".
